Governing law

The primary statute governing Texas property owners' associations is Chapter 209 of the Texas Property Code (the Texas Residential Property Owners Protection Act), which sets out requirements for board governance, elections, architectural control, records access, and assessments. Condominium associations are separately governed by Chapter 82 (the Uniform Condominium Act) for communities established since 1994, and by Chapter 81 for older associations. Texas has no state licensing requirement for HOA or community association managers: the Texas Real Estate Commission (TREC) holds no regulatory authority over associations or the companies that manage them, and no separate community association manager credential is required by state law.
