Governing law
Virginia law governs community associations through two parallel statutes: the Property Owners' Association Act (Code of Virginia Title 55.1, Chapter 18), which applies to planned communities formed after 1959, and the Virginia Condominium Act (Title 55.1, Chapter 19), which applies to condominium communities created after July 1, 1974. Both require associations to maintain reserve funds, adopt annual budgets, hold open board meetings with proper notice, provide disclosure packets in property sales, and follow due-process procedures before imposing fines. A separate chapter — Title 54.1, Chapter 23.3 — requires that any firm offering management services to a common interest community obtain a license from the Common Interest Community Board (CICB) under the Department of Professional and Occupational Regulation (DPOR). Licensing became mandatory on January 1, 2009. Firm employees who bear principal or supervisory responsibility for management services must also hold a CICB-issued certificate.
